The Urgency of Fair Contribution Principles in BPJS Kesehatan for Salaried Workers
Abstract
This article discusses the urgency of the principle of justice in BPJS Health contributions for wage workers. The aim of this research is to identify and analyze how the principle of justice can be realized in the BPJS Health contribution system for wage workers, as there is a discrepancy in determining the amount of contributions for wage workers in Presidential Regulation Number 64 of 2020 concerning the Second Amendment to Presidential Regulation Number 82 of 2018 concerning Health Insurance, especially Article 32 paragraph 2, with Article 81 number 31 and Article 90B paragraph (1) attachment of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation to become Law. The research method used in this study is normative legal research with a statutory and legal theory approach. The data used are sourced from literature, namely legislation and related literature. The results show that the principle of justice in BPJS Health contributions for wage workers can be realized by applying the principles of equality and social justice. The application of the principle of equality can be done by determining contributions based on the scale of the company, while the application of the principle of social justice can be done by providing subsidies or contribution assistance to wage workers who work in micro and small-scale companies.
