Juridical Problems on the Enforceability of Labor Regulations under Law No. 11 of 2020 on Job Creation

Abstract

The economy is structured as a joint effort; regarding labor issues, it is no longer solely about protecting those with a weak economy against those with a strong economy. Apart from achieving a balance between different interests, it is also a matter of finding the best way and means, without neglecting personality traits and humanity. People who do work get the best possible results from every job that has been determined to be their duty and as a reward for their hard work to get a decent living based on humanitarian principles. Therefore, it must be regulated and there needs to be a bond between workers and employers. This research is aimed at finding out how the latest law, namely Law No. 11 of 2020 concerning Job Creation, the regulations of which contain many changes that have an impact on the old law, namely Law No. 13 of 2003 concerning Employment, applies. This research is normative legal research, meaning that the law is interpreted as a rule, as a norm which contains commands and prohibitions. The sources of legal materials are literature, journals, and data from libraries. Based on the results, it can be concluded that the latest law has regulations that provide more special space between employers and their workers, but the government’s role is also as a regulator for workers and employers in its regulation. Changes or transitions that occur regarding a law are things that the government does to adjust the pattern or system of employee relations with employers.
