A Civil Law Perspective on the Consequences of Environmental Pollution Under Law No. 32 of 2009 on Environmental Protection and Management
Abstract
Environmental damage will have a domino effect on human life. Pollution and/or damage to the environment not only has an impact on the continuity of human life now but also threatens the continuity of human life in the future so that it is necessary to protect and manage the environment seriously and consistently by all stakeholders. This study aims to determine the impact of environmental pollution on people's lives and how to resolve disputes due to environmental pollution in a civil manner based on Law Number 32 of 2009 concerning Environmental Protection and Management. This study uses a normative method with description, systematization and explanation steps on positive legal issues in depth using a conceptual approach, statutory approach and systematic synchronization analysis. The results of the research show that the damage to the environment is due to the contamination of nature by irresponsible persons. The two mechanisms for resolving civil environmental disputes based on Law Number 32 of 2009 concerning Environmental Protection and Management start from settlements inside and outside the court.
